In September 2023, the California state assembly passed a bill that requires court hearings in child custody cases to include the parents’ affirmation of their child’s gender identity. However, Governor Gavin Newsom vetoed the bill.

The bill proposed that the judges must consider whether each of the parents has affirmed the identity of their child, saying the parents’ affirmation constitutes parental responsibility for providing for the “health, safety, and welfare of the child.”

In a statement, Governor Newsom said he is deeply committed to advancing the rights of transgenders in California, which was his guide in making decisions in his decades of public service. He added that the state observes caution in establishing legal standards that single out one characteristic. If he signed the bill, it could be used to diminish the civil rights of many vulnerable individuals, Governor. Newsom added.
